Nondisclosure states, which include Alaska, Hawaii, Kansas, Mississippi, Montana, New Mexico, North Dakota, South Dakota, Tennessee, Texas, and Wyoming, allow buyers and sellers to keep transaction prices private. When luxury homes sell off-market and avoid MLS listings entirely, assessors lose crucial comparable sales data needed to value properties accurately.

This information vacuum forces tax assessors to rely on older, incomplete datasets. Without recent sales comps in their area, assessors often apply across-the-board assessment increases or base valuations on outdated benchmarks. Homeowners in neighborhoods where wealthy buyers are acquiring properties off-market end up paying higher taxes based on inflated assumptions about their property values.

The problem concentrates in high-end markets. A $5 million estate sale that never appears in public records or the MLS leaves assessors blind to actual market activity. Meanwhile, a modest $300,000 home down the street gets assessed upward because it's the only recent comp the assessor can find. The owner of that modest home pays more because wealthy neighbors kept their transactions secret.

Texas represents the most extreme case.
