The settlement fund from the real estate commission lawsuit holds over $711 million as of September 30, 2026, but no timeline has been announced for payouts to eligible class members.
The Missouri jury found the real estate industry liable for artificially inflating commissions nearly three years ago. The National Association of Realtors settlement agreement received final court approval two years ago.
Morgan Stanley now holds the settlement funds, which were transferred there from Huntington Bank in October 2025 at the direction of class counsel. During the first nine months of 2026, the accounts earned over $17 million in interest. Roughly $5.8 million was transferred out during that period, though court filings do not explain the purpose of these transfers or whether any payments have reached class members.
JND Legal Administration, the settlement administrator, has processed over 2.7 million claim submissions. The company conducted six notification campaigns that included over 138 million emails and 44 million postcards, costing over $18 million in postage. JND invoiced the settlement fund nearly $33 million for administrative work as of June 2025 and invoiced nearly $156,000 for work conducted between July and September 2026.
Appeals courts rejected objector appeals of the settlement multiple times this fall. Objectors still retain the option to appeal to the U.S. Supreme Court, and it remains unknown whether any will do so. This uncertainty delays clarity on when eligible home seller class members will receive payouts.
